TERMS AND CONDITIONS OF USE

These Terms and Conditions of Use (“Terms”) govern the purchase and use of the Connect & Capture Prompt Deck and any related digital resources (“Connect & Capture,” “Product,” or “Offering”), created and provided by JBC Photography (“Company,” “we,” “us,” or “our”).

By purchasing, receiving, or using Connect & Capture, you (“you,” “your,” or “Purchaser”) acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you should not purchase or use Connect & Capture.

1. THE CONNECT & CAPTURE PROMPT DECK

Connect & Capture is a physical prompt deck designed to help photographers create meaningful, playful, and authentic interactions during in-home photography sessions.

The deck and all of its contents, including but not limited to the prompts, wording, concepts, card designs, graphics, illustrations, icons, branding, logos, names, packaging, and related materials, are the intellectual property of JBC Photography and are protected by applicable copyright, trademark, and other intellectual property laws.

Your purchase of Connect & Capture does not transfer ownership of the intellectual property contained within the Product to you.

Your purchase gives you the right to use the physical deck as described in these Terms.

2. PERPETUAL COMMERCIAL LICENSE

As the purchaser of your first and any additional Connect & Capture deck(s), you are granted a perpetual, non-exclusive, non-transferable, non-sublicensable commercial license to use Connect & Capture in connection with your own photography business, subject to these Terms.

This license is granted to the original purchaser only and may not be transferred, assigned, sublicensed, or shared with another individual, photographer, business, or organization.

The license remains in effect indefinitely unless terminated due to a material violation of these Terms.

Your commercial license includes:

Unlimited commercial use of the purchased Connect & Capture deck within your own photography business.

Use of Connect & Capture during paid or unpaid photography sessions with your own clients.

Use of Connect & Capture with an unlimited number of clients.

Permission to advertise or communicate that your photography sessions incorporate or are “powered by” Connect & Capture.

Permission to give your photography session or experience its own name while identifying Connect & Capture as the prompt deck being used.

For example:

“Our Home Storytelling Session uses the Connect & Capture Prompt Deck.”

or

“Powered by Connect & Capture.”

You may create your own name for the photography experience or session, but you may not rename, rebrand, modify, or represent the Connect & Capture deck itself as your own creation.

3. USE OF THE PHYSICAL DECK

You may:

Use Connect & Capture during your own photography sessions.

Use Connect & Capture with unlimited photography clients.

Incorporate Connect & Capture into your own photography session experience.

Advertise that you use Connect & Capture as part of your photography services.

Create and market your own photography session or experience that utilizes Connect & Capture.

Leave your purchased physical Connect & Capture deck with a client as a gift, if you choose to do so as part of your own business model.

If you give your physical deck to a client, that transfer applies only to the physical deck itself. It does not transfer ownership of JBC Photography's intellectual property or grant the recipient permission to reproduce, digitize, modify, distribute, teach, or commercially exploit Connect & Capture.

4. PROHIBITED USES OF THE PHYSICAL DECK

Your commercial license does not give you permission to reproduce, distribute, modify, or create derivative versions of Connect & Capture.

You may not:

-Copy or reproduce any Connect & Capture cards or prompts.

-Scan, photograph, digitize, upload, or otherwise convert the prompts or deck into digital files.

-Recreate the deck in any physical or digital format.

-Create your own version of the Connect & Capture deck or a substantially similar derivative product.

-Modify, rewrite, rearrange, or adapt the prompts for the purpose of creating another product or competing resource.

-Remove, replace, obscure, or alter Connect & Capture branding on the deck.

-Rebrand the Connect & Capture deck as your own product.

-Resell the Connect & Capture deck as your own product.

-Sell, distribute, share, or provide digital copies of the prompts to other photographers, clients, businesses, or third parties.

-Share your purchased deck with another photographer or business for their ongoing commercial use.

-Use Connect & Capture to create or sell another prompt deck, card deck, workshop curriculum, course, guide, template, or other commercial product without written permission from JBC Photography.

-Teach, host, or facilitate a workshop, class, course, or educational program centered on or substantially incorporating the Connect & Capture prompts without prior written permission from JBC Photography.

-Claim ownership of any Connect & Capture intellectual property.

-Use Connect & Capture in any unlawful manner.

5. DIGITAL COMPONENTS AND RESOURCES

Connect & Capture may include digital resources, materials, guides, templates, downloads, links, or other digital content provided by JBC Photography in connection with the Product (“Digital Components”).

Digital Components are provided under a limited, non-transferable license and remain the intellectual property of JBC Photography. Your purchase does not transfer ownership of any Digital Component to you.

Some Digital Components are designed specifically to be customized and shared with your own photography clients. Other Digital Components are intended solely for the personal or business use of the original purchaser. The permitted use of each Digital Component is determined by its intended purpose and any instructions provided by JBC Photography.

Client-Facing Digital Components

When a Digital Component is specifically identified or intended as a client-facing resource, you may:

-Customize the resource for your own photography business.

-Add your own business name, logo, branding, contact information, policies, and other appropriate business information.

-Modify the resource as reasonably necessary to reflect your own business and client experience.

-Provide or send the customized resource to your own photography clients for the purpose for which it was created.

-Use the customized resource as part of your own photography services and client experience.

However, you may not:

-Sell the template, resource, or a substantially similar version of it as a standalone product.

-Share the original, uncustomized template or editable file with other photographers, businesses, or third parties.

-Give another photographer or business access to your editable template or source file.

-Use the resource to create a competing product, template, guide, course, workshop, or other commercial offering.

-Claim ownership of JBC Photography's original content, structure, design, wording, or intellectual property.

-Remove copyright or ownership notices where they are included.

-Distribute the resource beyond your own clients for purposes unrelated to the client experience for which it was provided.

-Your clients may receive and use a customized client-facing resource provided to them by you, but they do not receive ownership of the original JBC Photography template or any underlying intellectual property.

Purchaser-Only Digital Components

Digital Components that are identified or intended as photographer-facing, educational, instructional, business-use, or purchaser-only resources are licensed solely to the original purchaser.

You may use these resources within your own photography business, but you may not:

-Share them with other photographers, employees, associate photographers, second shooters, contractors, friends, family members, or other third parties.

-Forward or distribute digital files, download links, access links, or editable files to anyone who has not independently purchased the applicable Connect & Capture product or received written permission from JBC Photography.

-Upload them to shared drives, Dropbox, Google Drive, online communities, websites, course platforms, or other locations where unauthorized individuals may access them.

-Reproduce, resell, sublicense, distribute, or commercially exploit them.

-Use them to create your own products, templates, guides, courses, workshops, or other resources for sale or distribution.

-If multiple photographers or members of your team require access to purchaser-only Digital Components, each individual must have their own applicable license or written authorization from JBC Photography.

Customization Does Not Transfer Ownership

Permission to customize a client-facing Digital Component does not transfer ownership of the underlying template or intellectual property to you.

You are receiving permission to customize and use the resource for your own photography business and client experience. JBC Photography retains all rights to the original Digital Component, including its underlying design, structure, concepts, wording, and other intellectual property.

You may not use your customized version to create, market, or distribute a competing product or resource.

If you are unsure whether a particular Digital Component is intended for client-facing use or purchaser-only use, you may contact JBC Photography at [email protected] for clarification before distributing it.

6. INTELLECTUAL PROPERTY

All intellectual property associated with Connect & Capture remains the sole property of JBC Photography.

This includes, but is not limited to:

-The Connect & Capture name

-The Connect & Capture logo and branding

-The prompts and written content

-Card designs and layouts

-Graphics, icons, and illustrations

-Packaging and product design

-Promotional materials created by JBC Photography

-Website content relating to Connect & Capture

-Digital Components

-Any accompanying digital materials

-The overall creative concept and presentation of the Product

Purchasing Connect & Capture does not give you ownership of any of this intellectual property.

You receive only the limited commercial license expressly described in these Terms.

Nothing in these Terms grants you permission to register, trademark, copyright, reproduce, distribute, license, sell, or otherwise claim ownership of any Connect & Capture intellectual property.

7. REQUESTS FOR PERMISSION

If you would like to use Connect & Capture, its prompts, branding, images, Digital Components, or other intellectual property in a way that is not specifically permitted by these Terms, you must obtain written permission from JBC Photography before doing so.

Permission must be granted in writing. Verbal conversations, social media messages, or assumptions of permission do not constitute authorization unless confirmed in writing by JBC Photography.

8. PHOTOGRAPHY BUSINESS USE

Connect & Capture is intended to be used as a tool within your own photography business.

You are responsible for determining how you incorporate the deck into your sessions, how you communicate its use to your clients, and how you price or market your photography services.

JBC Photography does not guarantee that use of Connect & Capture will result in any particular business, financial, client, marketing, or photographic outcome.

You are solely responsible for your own photography business, including client relationships, pricing, contracts, insurance, licensing, safety practices, and business operations.

9. CLIENTS AND PARTICIPANTS

Connect & Capture is designed to encourage interaction, movement, creativity, and connection during photography sessions.

You are responsible for determining whether a particular prompt is appropriate for your clients, their children, their environment, and the circumstances of the session.

JBC Photography is not responsible for injuries, property damage, accidents, or other losses arising from the manner in which you choose to use the deck during your photography sessions.

You should use reasonable judgment and appropriate supervision when using Connect & Capture with children or other participants.

10. PURCHASES AND PAYMENT

By placing an order for Connect & Capture, you agree to provide accurate and complete billing and shipping information.

You authorize the applicable payment processor to charge your selected payment method for the purchase amount, including any applicable shipping charges and taxes displayed at checkout.

Payment processing may be handled by a third-party payment processor. Your use of a third-party payment processor is also subject to that provider's applicable terms and policies.

JBC Photography reserves the right to correct pricing, product descriptions, or other errors on the website or checkout page.

11. SHIPPING

Connect & Capture is a physical product and will be shipped to the address provided by the Purchaser at checkout.

You are responsible for providing an accurate and complete shipping address.

JBC Photography is not responsible for delays caused by shipping carriers, incorrect addresses provided by the Purchaser, weather, natural disasters, or circumstances outside of our reasonable control.

If your order arrives damaged or does not arrive, please contact JBC Photography at [email protected]within a reasonable period after the expected delivery date so that we can determine the appropriate resolution.

12. RETURNS AND REFUNDS

Because Connect & Capture is a physical product containing copyrighted intellectual property, all sales are considered final unless otherwise stated by JBC Photography.

If your deck arrives damaged, defective, or there is an error with your order, please contact us at [email protected] so we can review the situation and determine whether a replacement or other resolution is appropriate.

Nothing in this section is intended to limit any rights you may have under applicable consumer protection laws.

13. PRODUCT CHANGES

JBC Photography reserves the right to modify, update, improve, discontinue, or change Connect & Capture or any related materials at any time.

Updates or changes to future versions of Connect & Capture do not automatically entitle previous purchasers to replacement decks, upgraded products, refunds, or additional materials unless otherwise stated by JBC Photography.

14. REVIEWS AND TESTIMONIALS

If you voluntarily submit a review, testimonial, photograph, video, or other feedback about Connect & Capture to JBC Photography, you grant JBC Photography permission to use that submission for reasonable business and promotional purposes, unless you specifically request otherwise in writing.

You represent that you have the right to provide any content you submit and that your submission does not knowingly infringe upon another person's intellectual property, privacy, or other rights.

JBC Photography reserves the right to decline to publish or remove any review or submission that is unlawful, misleading, abusive, or otherwise inappropriate.

15. DISCLAIMER

Connect & Capture is provided as a creative photography tool and resource.

JBC Photography makes no guarantees regarding specific photographic results, client experiences, business growth, revenue, bookings, or other outcomes resulting from use of the Product.

You are responsible for determining how and when to use each prompt based on the specific circumstances of your photography session.

To the fullest extent permitted by applicable law, JBC Photography disclaims liability for any loss, injury, damage, claim, or expense arising from the use or misuse of Connect & Capture, except where such liability cannot legally be excluded.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, JBC Photography and its owners, employees, contractors, agents, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to the purchase or use of Connect & Capture.

This includes, without limitation, loss of income, loss of business, loss of profits, loss of data, property damage, or claims arising from the use of the Product during a photography session.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. LICENSE VIOLATIONS

If JBC Photography determines that you have violated the commercial license or any other material provision of these Terms, we may terminate your license to use Connect & Capture.

Upon termination, you must immediately stop using Connect & Capture and any JBC Photography materials that you are no longer authorized to use.

Termination of the license does not prevent JBC Photography from pursuing any other rights or remedies available under applicable law.

JBC Photography reserves all rights regarding unauthorized reproduction, distribution, infringement, or other misuse of its intellectual property.

18. GOOD-FAITH RESOLUTION

If a dispute arises between you and JBC Photography concerning Connect & Capture, both parties agree to make a good-faith effort to resolve the issue directly before pursuing formal legal action, where reasonably possible.

Nothing in this provision prevents either party from taking action when necessary to protect intellectual property rights or to comply with applicable law.

19. GOVERNING LAW

These Terms and any dispute arising from or relating to Connect & Capture shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any legal proceedings arising from these Terms shall be brought in a court of competent jurisdiction in Florida, unless otherwise required by applicable law.

20. CHANGES TO THESE TERMS

JBC Photography reserves the right to update or modify these Terms from time to time.

The most current version will be identified by the “Last Updated” date at the beginning of these Terms.

Your continued use of Connect & Capture following any changes to these Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

22. ENTIRE AGREEMENT

These Terms, together with any applicable Privacy Policy, purchase terms, and other written agreements expressly incorporated herein, constitute the entire agreement between you and JBC Photography regarding your purchase and use of Connect & Capture.

No other representation, promise, or agreement shall modify these Terms unless made in writing and agreed to by JBC Photography.

23. ACCEPTANCE

By purchasing Connect & Capture, you acknowledge that you have had the opportunity to review these Terms and agree to be bound by them.

If you do not agree to these Terms, do not purchase or use Connect & Capture.
